PORTAGE COMMUNITY CENTER (PCC) CORNHOLE TOURNAMENT FUNDRAISER WAIVER, RELEASE OF LIABILITY, AND HOLD HARMLESS AGREEMENT
ASSUMPTION OF RISK
I acknowledge that participation in the Cornhole Tournament Fundraiser (the “Event”) involves inherent risks, including but not limited to personal injury, property damage, accidents, or other unforeseen circumstances. I voluntarily assume all risks associated with my participation in the Event.
RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Portage Community Center (PCC), its officers, board members, employees, volunteers, agents, and affiliates from any and all liability, claims, demands, losses, or damages arising out of or related to my participation in the Event, including but not limited to those caused by negligence, weather conditions, alcohol consumption, or otherwise.
HOLD HARMLESS AND INDEMNIFICATION
I agree to indemnify, defend, and hold harmless PCC from and against any and all claims, actions, damages, costs, or expenses (including attorney’s fees) arising out of or related to my participation in the Event, including claims brought by third parties due to my actions.
WEATHER POLICY
I understand and acknowledge that the Event is weather-dependent. PCC reserves the right to modify, delay, or cancel the Event due to weather or other unforeseen circumstances. No refunds will be issued for any reason, including but not limited to weather-related changes or cancellations.
PLAY AT YOUR OWN RISK
I understand that I am participating in the Event at my own risk. PCC is not responsible for any injuries, losses, or damages that may occur before, during, or after the Event.
ALCOHOL POLICY
I acknowledge that alcohol may be present at the Event. I agree that:
- I will comply with all applicable local, state, and federal laws regarding alcohol consumption;
- I will only consume alcohol if I am of legal drinking age;
- I will drink responsibly and will not operate a vehicle while under the influence;
- PCC reserves the right to refuse service, remove, or disqualify any participant or attendee who appears intoxicated, disruptive, or unsafe;
- I assume all risks related to the consumption of alcohol and release PCC from any liability arising from alcohol-related incidents.
SUBSTITUTE PLAYERS
If I am unable to participate and choose to have a substitute player take my place, I agree that:
- I am responsible for informing the substitute of all Event rules and requirements;
- The substitute player must agree to and comply with this Waiver and all Event rules;
- PCC is not responsible for any actions or conduct of substitute players.
RULES AND AUTHORITY
I agree to abide by all rules and decisions set forth by the Portage Community Center Board. I understand that all decisions made by the PCC Board are final.
ACCURACY OF INFORMATION
I certify that all information I have provided is true and accurate. I understand that providing false information may result in disqualification from the Event without refund.
GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Michigan. Any legal action arising from this Agreement shall be filed in a court of competent jurisdiction in Kalamazoo County, Michigan.
ACKNOWLEDGMENT
I have read this Waiver, Release of Liability, and Hold Harmless Agreement in full. I understand its terms and sign it freely and voluntarily.
